1. DEFINITIONS

Application: The mobile and/or web application offered under the Finportill brand, including portfolio tracking, financial analysis, and reporting services.

User: The natural person who accepts these Terms by downloading the Application or creating an account via the website.

Services: All functions offered through the Application, including portfolio viewing, financial data analysis, reporting, single-analysis report purchases, and subscription-based features.

Store: The Apple App Store or Google Play Store platform through which the User downloads the Application and makes payments.

Subscription: The weekly, monthly, or annual paid plan the User purchases through the Store to access the Services.

Single Analysis: An individual analysis report product accessed through a one-time purchase, outside of a subscription.

2. ACCEPTANCE AND SCOPE OF THESE TERMS

2.1 A User who downloads the Application and creates an account, or who uses any of the Services, represents that they have read, understood, and accepted these Terms.

2.2 Finportill reserves the right to modify these Terms at any time. Updated Terms take effect from the moment they are published within the Application or on the website. Continued use of the Services after such changes constitutes acceptance of the updated Terms.

2.3 Users under the age of 18 are not permitted to use the Application.

3. ACCOUNT CREATION AND IDENTITY VERIFICATION

3.1 To use the Services, the User must create an account with accurate, current, and complete information.

3.2 Finportill reserves the right to request additional identity verification information and documentation from the User under applicable regulations (including data protection law, financial regulations, and any KYC/identity verification requirements imposed by competent authorities). The User is obligated to provide the requested information within a reasonable time.

3.3 The User is solely responsible for the confidentiality of their account credentials (username, password, etc.) and for all activity carried out through their account. If unauthorized use of the account is suspected, the User must notify Finportill immediately.

3.4 Finportill reserves the right to suspend or close an account, stating its reasons, if inconsistencies, suspected fraud, or regulatory violations are identified during the verification process.

4. NATURE OF THE SERVICES AND INVESTMENT RISK DISCLOSURE

4.1 The portfolio tracking, analysis, and reporting services offered through Finportill are for general informational and technical analysis purposes only. The content of the Application does not, under any circumstances, constitute investment advice, brokerage activity, or individual investment recommendations.

4.2 Investment advisory activity may only be provided by authorized institutions taking into account an individual's risk and return preferences. The commentary, data, and content contained in the Application's analyses and reports do not fall within this scope and cannot be treated as "investment advice."

4.3 Transactions carried out in financial markets may involve risk. The User acknowledges that they are solely responsible for the outcomes of any investment decisions made based on the information and analyses provided in the Application.

4.4 Finportill exercises reasonable care regarding the accuracy and timeliness of the data provided, but cannot be held responsible for errors, delays, or omissions originating from third-party data sources.

5. SUBSCRIPTION, PRICING, AND PAYMENT TERMS

5.1 Access to Finportill Services is provided through the following paid plan options:

5.1.1 Weekly Subscription,
5.1.2 Monthly Subscription,
5.1.3 Annual Subscription,
5.1.4 Single Analysis (a one-time purchase that does not require a subscription).

5.2 All payments are processed through the Store (Apple App Store or Google Play Store) from which the User downloaded the Application. Payment processing, invoicing, auto-renewal, cancellation, and refund procedures are governed by the Store's own terms and policies; responsibility for these processes lies with the relevant Store, not with Finportill.

5.3 Subscriptions renew automatically at the end of each period unless canceled by the User through the Store settings. Cancellation must be carried out directly through the relevant Store account settings.

5.4 Finportill reserves the right to update plan prices at any time. Price changes take effect from the end of the current subscription period and are communicated to the User via the Store.

5.5 Refund requests must be submitted to the relevant Store under its own refund policy; Finportill does not process refunds directly.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 All intellectual property rights in the software, design, brand, logo, analysis methodology, and other materials contained within the Application belong to Finportill.

6.2 The User is granted a non-exclusive, non-transferable right of use, limited to personal and non-commercial purposes. Unauthorized reproduction, distribution, or commercial use of the Application's content is prohibited.

7. LIMITATION OF LIABILITY

7.1 Finportill makes no express or implied warranty that the Services will be uninterrupted, error-free, or fit for any particular purpose.

7.2 To the maximum extent permitted by applicable law, Finportill shall not be liable for any indirect, incidental, or consequential damages arising from use of the Application, including loss of profit, data loss, or investment losses.

7.3 The limitations in this section do not affect the application of any mandatory provisions of applicable consumer protection law.

8. SUSPENSION AND TERMINATION OF ACCOUNT

8.1 The User may close their account at any time through the in-app settings. Closing the account does not automatically terminate an active subscription managed through the Store; subscription cancellation must be carried out separately through the Store.

8.2 Finportill reserves the right to suspend or close a User's account, with or without prior notice, in the event of a breach of these Terms, suspected fraud, detection of unlawful use, or obligations arising from applicable law.

8.3 Closure of the account does not eliminate any payment obligations that arose prior to the closure date.

9. PRIVACY

9.1 The principles governing the processing of personal data are set out separately in the Privacy Policy published within the Application. By accepting these Terms, the User is also deemed to have accepted the Privacy Policy.

10. GOVERNING LAW AND JURISDICTION

10.1 These Terms are governed by, and shall be interpreted in accordance with, the laws of the Republic of Türkiye.

10.2 For any dispute arising from these Terms, including where the User holds consumer status, the competent Consumer Arbitration Committees and Consumer Courts, together with the courts and enforcement offices of Turkiye, shall have jurisdiction in accordance with applicable law.

11. EFFECTIVE DATE

These Terms take effect from the moment the User downloads the Application and creates an account, or begins using any of the Services.
